Terms of Service
These Terms of Service (hereinafter referred to as the “Terms”) define the handling of users’ personal information by Kubota Masataka (hereinafter referred to as “we” or “us”), the developer of "Namakeru" (hereinafter referred to as the “Service”).
By downloading or using the Service, users are deemed to have agreed to the content of these Terms.
Article 1 – Scope of Application
- These Terms apply to all relationships between the user and us regarding the use of the Service.
- In addition to these Terms, we may establish individual rules and other provisions regarding the use of the Service (hereinafter referred to as “Individual Provisions”). Regardless of their title, these Individual Provisions shall constitute a part of the Terms.
- In the event of any inconsistency between these Terms and the Individual Provisions, the Individual Provisions shall take precedence unless otherwise specified.
Article 2 – About the Service
- The Service provides a set of applications that allow users to manage, record, and access personal information and data through digital devices.
- Users may use the Service for personal or business purposes.
- The Service offers features aimed at improving convenience and enhancing productivity.
Article 3 – Fees and Payment Methods
- Users shall pay the fees specified by us for any paid features of the Service.
- Payment is made through an automatically renewing subscription via the App Store or Google Play.
- Unless explicitly canceled by the user, the subscription will be automatically renewed at the end of the current billing period. Users may cancel the subscription at any time, but the cancellation will take effect after the current period ends.
- To cancel the subscription, users must do so through the subscription management page of the respective platform (App Store or Google Play).
Cancellation is not immediately reflected and the subscription remains valid until the end of the current period.
The impact of cancellation on future charges may vary depending on each platform’s policy.

- Even after cancellation, users may continue to access the paid features of the Service until the subscription period expires.
Article 4 – Prohibited Conduct
Users must not engage in the following actions when using the Service:
- Acts that violate laws or public order and morals
- Criminal activities or acts related to crime
- Infringement of intellectual property rights
- Destruction or obstruction of server or network functionality
- Unauthorized access
- Use for fraudulent purposes
- Reverse engineering or analysis of the Service's source code
- Unauthorized use of other users' accounts or data
- Excessive use of resources that imposes a burden on the Service
- Any other acts deemed inappropriate by us
Article 5 – Suspension of the Service
We may suspend or interrupt all or part of the Service in the following cases:
- For maintenance or updates of the system
- Due to natural disasters or other force majeure events
- In the event of a communication equipment failure
- If we determine it is difficult to provide the Service
We shall not be liable for any damages such as data loss caused by temporary unavailability of the Service.
Article 6 – Restrictions and Account Termination
We may restrict user access or delete accounts under the following circumstances:
- Violation of these Terms
- Failure to make payments
- No response to our communications
- Any other situations deemed inappropriate by us
We shall not be liable for any damages caused by such actions.
Article 7 – Withdrawal
Users may withdraw from the Service by following the procedures we specify.
Article 8 – Disclaimers and Limitation of Liability
- We make no warranties regarding the Service.
- We are not liable for any indirect damages such as data loss or loss of business opportunities arising from the use of the Service (except in cases of intentional misconduct or gross negligence).
- If the Consumer Contract Act applies, our liability shall be limited in accordance with applicable laws.
Article 8-2 Handling of Guest User Data and Plan-specific Data Retention
- Guest plan user data is stored for 1 week, after which it will be sequentially deleted and cannot be restored.
- If there are no data entries for 1 week and the guest user account is older than 1 week, the account will be deleted.
- Guest users cannot transfer or restore data when switching devices, uninstalling the app, or if the UUID stored in the app is lost due to app malfunctions.
- Free plan user data is deleted after 1 month and cannot be restored.
- Premium plan user data has no retention period limit, but if the subscription is cancelled, data will be retained for 3 years after the subscription ends, and all data will be permanently deleted after that period.
Article 9 – Modifications to the Service
We may modify, add, or discontinue all or part of the Service with prior notice (in principle, at least 30 days in advance).
Article 10 – Changes to the Terms
- These Terms may be revised within a reasonable scope.
- We will notify users in advance of any changes, including the effective date and details of the revisions.
Article 11 – Handling of Personal Information
Personal information obtained through the use of the Service will be handled appropriately in accordance with our separate Privacy Policy.
Article 12 – Prohibition of Transfer of Rights and Obligations
Users may not assign or pledge their contractual rights or obligations to any third party without our prior written consent.
Article 13 – Governing Law
These Terms shall be governed and interpreted in accordance with the laws of Japan.
